By emailing, posting, publishing, uploading or otherwise transmitting content to any Forum or submitting any content to Objectivity, you automatically grant (or warrant that the owner of such rights has expressly granted) Objectivity an irrevocable, non-exclusive, perpetual, royalty-free license and right to adapt, distribute, modify, publish, reproduce and transmit such content in any form, medium or technology now known or later developed, subject to prior agreements with Objectivity. In addition, you warrant that you have waived all so-called moral rights in the content. You should note that legally executed Non-Disclosure Agreements with Objectivity, Inc. generally over-ride the prior contents of this paragraph.

Thank you for using Max&Mark/Ning, ("Max&Mark/Ning", "we" or "us")! Max&Mark/Ning provides a software platform (the "Max&Mark/Ning Platform") that enables you to create, join or browse Social Networks (as defined below) built on the Max&Mark/Ning Platform.

We also provide a set of services that will enhance your experience as a member of Social Networks on the Max&Mark/Ning Platform.

These Terms of Service contain general terms that apply to you as a user of the Max&Mark/Ning Platform, along with additional terms that may apply to you as a Network Creator (as defined below) if you decide to create your own Social Network. When using the Max&Mark/Ning Platform, you will also be subject to the Max&Mark/Ning Privacy Policy and additional posted guidelines, policies or rules applicable to specific services and features on the Max&Mark/Ning Platform, which may be posted by us from time to time (collectively, the "Guidelines"). All of these Guidelines are part of this Agreement and are hereby incorporated by reference. Additionally, if you are developing networks, products or services using Max&Mark/Ning's application programming interfaces ("APIs"), or have otherwise signed up for a developer account (thereby becoming a "Third Party Application Developer"), you will also be subject to the Max&Mark/Ning Application Developer Terms. If you are adding third party widgets and applications ("Third Party Applications") or adding custom code not provided by or endorsed by Max&Mark/Ning ("Non-Max&Mark/Ning Code") to your Social Networks or adding applications that may be developed or contributed by Max&Mark/Ning ("Max&Mark/Ning Applications") to either your Social Network or a third party web site, you will also be subject to the Max&Mark/Ning Applications Terms.

The Max&Mark/Ning Application Developer Terms and Max&Mark/Ning Applications

These Terms of Service, including any Guidelines and future modifications (collectively the "Terms of Service" or "Agreement") govern your use of the Max&Mark/Ning Platform and is a legal contract between you and Max&Mark/Ning.
